Postage and Packaging

Items are posted via Australia Post and are subject to their terms and conditions. We are not responsible for any damage done to the package in transit as we have fulfilled our obligation to package and dispatch the item with due care. Very delicate items are wrapped in bubble wrap and/or in boxes where appropriate. Items like dresses are packaged in protective bags before being placed in Australia Post tough satchels.

Some items are shipped to us by their manufacturer in sealed packaging rather than with swing tags. As we remove this packaging to check each item before it is send to you, these items will not contain a swing tag when they are sent to you. We keep records of the items that are sent out without swing tags. All items contain sewn in tags and are brand new.

We may send large items or orders from customers whose delivery address is outside of the Australia Post Express Network via Registered Post - for the benefit of extra cover and signature on delivery.

Retail only / non competitive declaration

By purchasing from our website you are making a legal declaration that you are not a competitor of any part of the Fashtico family. You also declare that you are not purchasing these items to resell on an auction website, in an offline shop, or on another website.

Our prices are designed to make clothing affordable to end customers, and not to be resold at higher prices. Customers found to be breaking these terms will have their accounts terminated without notice, and we reserve the right to take legal action against these businesses.

Pricing

All prices on our website are in Australian dollars and include 10% GST. GST is not applied to New Zealand orders.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. We do not sell products for children, but it sells them to adults. If you are under 18, you may use this website only with involvement of a parent or guardian. Our website and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

Payment

Please refer to our payments page, as this forms part of our terms. When paying by bank transfer please note that although we allow 2 business days for a bank transfer order to clear, if an order that is cancelled due to non-payment and is then re-ordered we will only allow 1 business day for the re-order to clear. In that situation, you'd need to go into a National Australia Bank branch and make a cash deposit (as other forms of bank transfer take more than one business day to clear). If an order is cancelled twice, we will only accept credit card payments for future orders.

In situations where we are making a refund payment to you for any reason, administrative processing may take up to two weeks. Your credit card provider or bank may take additional time for the refund to process back on to your card.

Electronic Communications

When you visit our website or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Pricing

Except where noted otherwise, the Recommended Retail Price displayed for products on our website represents the full retail price listed on the product itself, suggested by the manufacturer or supplier, or estimated in accordance with standard industry practice. The List Price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day.

For certain items that are offered as a set, the Price may represent "open-stock" prices, which means the aggregate of the manufacturers estimated or suggested retail price for each of the items included in the set. Where an item is offered for sale by one of our merchants, the List Price may be provided by the merchant.

With respect to items sold on our website, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. If we discover a mispricing, we will do one of the following:

- If an items correct price is lower than our stated price, we will charge the lower amount and ship you the item.

- If an items correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

Please note that this policy applies only to products sold and shipped by us. Your purchases from third-party sellers using our Payments are charged at the time you place your order, and third-party sellers may follow different policies in the event of a mispriced item.

All prices are stated including GST.

Display of GST for International Customers

International customers are not subject to GST. Shipping costs will be displayed on checkout with a label that reads "including tax" but the amount of tax included in international orders is always zero. We do not collect GST on any part of international orders, as per Australian law.

Loyalty points

Any loyalty points accrued through purchases on our website are non transferrable and cannot be converted into cash; if you close your account, any points accrued on your account are forefitted.

Please also note that when points are converted into vouchers for use, the vouchers generated are not valid on clearance items, boots, shoes, lingerie, or swimwear. These restrictions are set by us manually, and if you try to use a voucher before these restrictions are set, the entire order will be cancelled and refunded. You can contact us if you need more information about this prior to using a voucher.

The rate of conversion of loyalty points is subject to change at any time without notice so if you want to take advantage of a particular rate, convert your points into a voucher. You can do this by logging into your account, choosing "my loyalty points" from the "My account" screen, then choosing "Transform my points into a voucher". Unused converted vouchers expire after 12 months.

Returns and shipping policies

Our website publishes fair and comprehensive returns, payment and shipping policies. By adding items to cart and/or ordering through the website you agree to these terms and conditions about returns, payments and shipping. Please read these before checking out.

Please note that if an order can only be cancelled within the first 24 hours after it is placed (provided that preparation and packing for dispatch has not yet commenced). For cancelled orders, a 5% cancellation fee applies.

We reserve the right to make changes to our site, policies, and these Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Clearance items

Tags may not be included on clearance items that we send out. Please also note that for fairness to all customers, there is a limit of 2 of the same type of garment (ie. SKU) per order. We may also photograph items before they are sent out as proof of quality.

Multiple Lots - Maximum of 2 per order

We are a retail only store, and do not permit bulk purchasing by wholesalers or resellers. Resale is expressly prohibited so we do not allow more than 2 of the same item to be purchased in any one order. Providing multiples to any customer or in any order is at our sole discretion. We will not allow attempts by resellers to bypass our terms and conditions.

Vouchers, Store Credits and Discounts
Discount codes are not available on exchanges or with other promotions. Any discount codes or vouchers that are designated non-cumulative by the system cannot be used with any cumulative vouchers or with any other promotions.

Vouchers and credits are non-transferrable and cannot be resold or given to someone else. This applies to both purchased vouchers and vouchers awarded as a prize in any competition that Clothingwear.com.au is associated with.

Vouchers and Store Credits are processed manually, and the per-unit price that applies is the one effective at the time it is processed (not the time requested). To avoid missing out on specials, we recommend that requests to use vouchers are sent to us early in the day during business hours on working days. This maximises the chances the special will still be in effect at the time your request is processed.
